When it comes to family law in New Jersey, a family law issue is handled by the Family Division of the New Jersey Superior Court, typically at the county level. The court process varies depending on the case, but we will explain how to go to family court and other information you should know.

Family Court Trial Procedure What Happens at a Family Court Trial?

During the trial the Plaintiff’s attorney will call witnesses that support the Plaintiff’s position. The Plaintiff’s attorney will then examine the witness who will then be cross examined by the Defense attorney. Once the Plaintiff has rested their case, it is the Defendant’s turn to present evidence. If there is a Guardian ad Litem, he or she also participates in questioning witnesses and can also call his or her own witnesses. The Judge may also ask questions of the witnesses.

Once all the testimony and evidence are presented in court, the Judge will deliberate and make his or her ruling, in the form of a written final order or “Decree.”

Family Court Hearing: What to Expect

At the family court hearing most judges will want to conference the case to give you an opportunity to settle. Once you start the trial, the judge may want you to present an opening statement, or at least ask you if you want to.

The plaintiff may put on a rebuttal case to address issues that were brought up in the defendant’s case. After the rebuttal case is over, comes time for Summations. After the summations are submitted, it may be weeks or months before you hear a decision.

Your day in court may really look more like several days depending on your case, which is something important to keep in mind.
