- The dog owner had a duty to prevent the dog from injuring others;
- The dog owner breached that duty; and
- The victim was injured due to this breach.
The victim must prove each of these elements to prevail in a negligence claim. If the victim cannot prove all three of these elements, the claim will fail and the victim will not be entitled to any damages. The victim will assume responsibility for all medical bills and other expenses associated with the injuries.
