  • The dog owner had a duty to prevent the dog from causing injuries;
  • The dog owner breached this duty by failing to reasonably restrain the dog; and
  • Due to this breach, the victim suffered damages.

In a negligence claim, the dog’s history and the conduct of the owner may be considered. If the dog had a history of attacking others and if the dog owner failed to take reasonable measures to restrain the dog, the dog owner will likely be liable for the victim’s injuries.
